Children
Although there are exceptions parents must firstly attend mediation to try and resolve their parenting dispute with organisation such as the Family Relationships Centre, Lifeline, Relationships Australia or with a qualified dispute resolution practitioner. We can assist you with your choice of the most suitable type of mediation for your situation.
You must take care not to enter into any parenting plans until you have had expert advice on how the law applies to your individual situation.
Property
You need to make sure you are aware of the enquiries and documentation you need about income assets and liabilities and what the likely entitlements are for you and your partner. That way, you will be fully informed and equipped for the mediation to be successful.
If you can’t reach an agreement, don’t delay too long. If an application for property settlement is not made within 12 months of your divorce becoming final or within 2 years of separation for de facto couples, permission from the Court to proceed is necessary and that will only be granted in cases of hardship.
