For gay and lesbian couples, it is often important for there to be full recognition and true understanding of property and children’s issues flowing from separation. For couples separating after 1 March 2009, these matters are dealt with in the Federal Magistrates Cout or Family Court.

De facto property rights including same sex relationships, are now dealt with under the same law as for married couples. Its possible to make an application for property settlement if partners have lived together for 2 years, had a child together or a partner has made a significant contribution which would result in an injustice if it were not recognised.
