First steps if you’ve been injured in a public place in the Northern Territory?

  1. Report the incident and your injuries to the relevant person/entity, that you have suffered an injury at their premises (eg if shopping centre, then call the Centre management to report the injury, then follow that up with an email to them);
  2. Take any photos of the scene of the accident with your phone (and save them);
  3. If there are any witnesses present when you suffered your injury, try to get their names and contact phone numbers;
  4. Seek medical treatment straight away and make sure you tell the doctor how you hurt yourself (this is very important);
  5. Get legal advice as soon as you’re feeling up to it (the sooner the better so that your lawyer can review the facts and take necessary steps to protect evidence, get statements etc)

What compensation is available with a public liability claim?

You are entitled to seek damages to compensate you for:

  • your pain and suffering generally due to the injuries you sustained;
  • any loss of income (earnings etc) due to your injuries preventing you from working;
  • any out-of-pocket expenses you incur due to treatment of your injuries;
  • in some cases, you can seek compensation because you have needed family and/or friends to provide you with assistance (due to your injuries).
